THE CORPORATION OF THE TOWNSHIP OF UXBRIDGE
NOTICE OF INTENT TO CONSIDER REMOVAL OF A HOLDING SYMBOL FROM THE ZONING BY-LAW

The Council for the Township of Uxbridge is considering an amendment to the Township Zoning By-law 81-19 for the lands shown on the Key Map which is enclosed with this notice for ease of reference. The requested change is described below:

APPLICANT:                        2223963 ONTARIO INC. (BEST WAY STONE)

LOCATION:                         
CERTAIN LANDS LOCATED IN PART OF LOTS 14 AND 15, CONCESSION ROAD 1, AND BEING COMPRISED OF LOT 23 ON PLAN 40M2336, IN THE GEOGRAPHIC TOWNSHIP OF UXBRIDGE, REGION OF DURHAM AND KNOWN MUNICIPALLY AS 67 ANDERSON BOULEVARD.

PURPOSE AND EFFECT:                              
To remove the Holding (H) Symbol from the subject lands, which are currently zoned “Holding Rural Industrial Zone Exception No. 38 (M1-38)”.

The purpose of the Holding Symbol for the M1-38 Zone is to ensure that:

THAT the Council of the Corporation of the Township of Uxbridge shall not remove the Holding (H) Symbol from the Holding Rural Industrial Exception No. 38 ((H) M1-38) Zone on the lands which are the subject of this by-law until the following conditions have been complied with:

  1. That a subdivision agreement respecting the lands has been fully executed by the Owner and the Township of Uxbridge or the Region of Durham, whichever is appliable, and that a site plan agreement has been executed by the Owner; and,
  2. That it has been determined that the proposed use complies with the applicable policies of the Region of Durham Official Plan regarding water usage.

Any written submissions must be made in writing prior to the passing of this Amending By-law and should be provided to the Director of Legislative Services/Clerk of the Municipality.

APPEAL PROCEDURE:

Under Section 36(3) of the Planning Act, only the applicant has appeal rights with respect to the removal of a Holding (H) symbol.  There are no third-party rights to appeal the proposed Zoning By-law Amendment.

TAKE NOTICE that the Council for the Township of Uxbridge will consider a By-law to remove the Holding symbol pursuant to Section 36 of the Planning Act, R.S.O.1990,C.P.13, no earlier than MONDAY, JULY 8, 2024.
