Bridgebrook Corporation (The Applicant), is the owner of undeveloped lands approximately 40 hectares in size, located in the northern portion of the Uxbridge Urban Area between Concession Road 6 and Centre Road, generally north of Bolton Drive, municipally known as 7370 Centre Road.
The Applicant submitted applications on April 9, 2021, to amend the Region’s Official Plan, the Township’s Official Plan, and the Township’s Zoning By-law, as well as for approval of a draft plan of subdivision. The Applicant appealed the applications to the Ontario Land Tribunal ('OLT') on March 16, 2022.
In a decision issued January 31, 2023, the OLT dismissed a motion by the Township to phase the hearing. As a result, all evidence in connection with the applications was required to be heard in a single hearing.
On January 15, 2024, a settlement hearing took place at which the Applicant, the Township and the Region presented a settlement regarding the proposed development with the consent of all other parties to the hearing.
In reaching a settlement, the Bridgebrook Lands and other Phase 2 Lands are now referred to as 'Evolving Neighbourhood Areas'. The Township, in consultation with the Region, retain the rights to determine when and if lands in the Evolving Neighbourhood Areas are to be allocated servicing capacity for development. Until the conditions for servicing allocation are met, these lands cannot be developed.
The settlement also ensures that the following conditions will be upheld when development eventually occurs:
- Environmental lands will be protected.
- 20 acres of parkland, open space, walkways, and trails will be provided.
- Traffic impacts will be minimized with traffic calming measures and improvements provided.
- Development designs will be compatible with existing developments and offer a mix of housing types.
The Township believes the settlement was an efficient way to manage future development while retaining Township rights in connection with servicing allocation and enabling all parties to achieve their objectives. Township staff will continue to use all expertise available to ensure any future development is carried out responsibly and sympathetically to the existing community and is representative of good planning practices.
