Proposed Zoning By-law Changes

The Council of the Township of Uxbridge is currently considering changes to its Zoning By-law which will make it easier and less costly for small business owners to operate in the Township. These changes will permit the use of barns and other accessory buildings for small businesses in the rural area without a rezoning, provided certain conditions are met.

The Township is also considering changes to update the existing regulations which allow homeowners to operate a small business from their house (called a home occupation) anywhere in the Township, provided certain conditions are met. In particular, currently only residents of the dwelling are permitted to be employed in the business; the proposed new regulations will allow one additional employee who does not live on the premises.

The Township is seeking public input on the proposed changes to the zoning by-law. The following information is intended to assist the public in providing that input.

Opportunities for Public Input

A public open house was held on September 17, 2009 which was well attended and many good suggestions were made on improvements to the proposed regulations.

The Township expects to hold at least two additional meetings with respect to this issue. Notice of these meetings will be announced here, in the newspaper and will also be mailed to those who attended the first open house and provided their contact information.

Frequently Asked Questions

Why is the Township making these changes now?

Home industry uses have never been permitted by the Township. However, relatively recently the Province, through the Oak Ridges Moraine Conservation Plan and the Greenbelt Plan permitted home industry uses. Both these plans affect the Township and the Township must conform to them. Therefore, anyone who wishes to undertake a home industry use can now apply to the Township to amend the zoning by-law to permit the use. A zoning amendment is costly. The Township felt it was more appropriate to proceed with a general amendment to the zoning by-law to allow home industry uses without a zoning by-law amendment. At the same time they are considering updating the regulations for home occupations which have always been permitted in the Township.

What if I have an existing, legal home occupation or home industry use how will these changes affect me?

Anyone who has an existing legal home occupation or home industry use will not be affected by these changes.

What if I have a home industry use that was established before 1981 when the current zoning by-law came into place, how do these changes affect me?

Any use existing before 1981 will not be affected by these changes.

Will these changes increase my taxes?

The assessment of your property, on which your taxes are based, is carried out by an agency of the Provincial government (MPAC). This process is not related to any change in your zoning. It is based on the use of your property, be it legal or illegal. As a result, the proposed zoning changes will not directly affect your taxes.

Some of the proposed regulations do not seem right to me. Will the Township consider changing them?

Township Council and staff want to make sure that the regulations do not create unnecessary problems. They are carrying out this review to ensure that any issues with the proposed regulations are identified so that they can be revised prior to being finalized.

Will the Township require a license for home occupation and home industry uses?

The Township is not going to license home occupation uses.

It has been suggested that consideration be given to licensing home industry uses because of certain policies in the Oak Ridges Moraine Conservation Plan and the Greenbelt Plan. However, no decision has been made on this proposal and it is not related to the proposed changes to the zoning bylaw. Your input with respect to this proposal is welcomed by the Township
